Terms and Conditions
By planning travel with Dreaming About the Mouse Travel, LLC, dba, Dreaming About Vacations (“we/us/our”, "DATM Travel, “Agency”) and our travel advisors , you agree to be bound by these Terms & Conditions. You (“you/your”, “Client”) acknowledge that Dreaming About the Mouse Travel, LLC acts as a sales agent for any airline, hotel, car-rental company, tour operator, cruise line, or other service providers (“Suppliers”) and that Dreaming About the Mouse Travel, LLC is not the source or provider of any travel services. These terms include warranties and disclaimers and exclusions of liability and may restrict your rights and remedies and provide protection to Dreaming About the Mouse Travel, LLC You warrant that you are at least 18 years of age and possess the legal authority to enter into this Agreement and to make travel bookings with Dreaming About the Mouse Travel, LLC . You agree to be financially responsible for all of your travel bookings made on behalf of yourself and any member of your traveling party and warrant that all information supplied by you on behalf of yourself, members of your household, or others for whom you are authorized to transact business with us is true and accurate. You agree that you will only make legitimate reservations or purchases with us and our Suppliers, and acknowledge that, without limitation, any speculative, false, or fraudulent reservation is prohibited. Dreaming About the Mouse Travel, LLC accepts all bookings solely as the booking agent for the travel Suppliers on your itinerary. Separate Supplier terms and conditions will apply to your reservation and purchase of travel-related goods and services that you select, and you understand and agree that by booking travel through Dreaming About the Mouse Travel, LLC , you are also agreeing to the booking terms of each Supplier partner you have selected for your itinerary. You agree that you will abide by the terms and conditions of purchase imposed by any Supplier that you have selected as a service provider on an itinerary you have approved. We are not liable or responsible for any travel arrangements made independently. I consent to and request the use of those suppliers and agree not to hold DATM Travel responsible should any of these suppliers: 1) fail to provide the travel services I have purchased; 2) fail to comply with any applicable law; or 3) engage in any negligent act or omission that causes me any sort of injury, damage, delay or inconvenience.
Documentation
I will review my travel documents for accuracy upon receipt and understand that I may contact DATM Travel if I have any questions. If there is any incorrect information then I understand it is my responsibility to let DATM Travel know immediately. NO REFUND will be issued for any costs or losses incurred as a result of Traveler’s failure to obtain or provide required travel documentation. I understand that discounted fares typically involve restrictions and that changing any aspect of my travel arrangements may result in the payment of additional money. Conversely, cancellation of any aspect of my travel arrangements may result in financial penalties, in accordance with the supplier’s cancellation policies. Dreaming About the Mouse Travel, LLC is not responsible for the issuance of travel identification such as passports and/or visas and travelers should ensure they have or have been approved for the appropriate documents before purchasing travel. I understand that if traveling internationally, I must have a valid passport and depending upon my destination and nationality, I may need to obtain one or more visas. I understand that my passport needs to be valid at least 6 months past the last day in the country I am visiting. Minors of age 17 and under traveling alone or with a single parent may be required to have additional documentation. I understand that the Transportation Security Administration requires me to carry a government issued identification card in order to board a flight. I have been advised that the name, date of birth and gender that appears on my identification card must exactly match the same such data that is listed on my airline ticket and in my booking records. I acknowledge that my failure to strictly comply with these requirements may result in denied boarding or an undue delay at an airport security checkpoint causing me to miss my flight. NOTE TO CLIENT: Passport and visa information may be obtained by contacting the Travel Advisory Section of the US State Department at 202.647.5225 or by visiting the State Department’s website at travel.state.gov. Non-US passport holders should be sure to contact the embassies of their destination and transit countries to obtain entrance requirements. To obtain medical information, you may contact the Centers for Disease Control at 404.332.4559 or visit the CDC’s website at www.cdc.gov. I understand that it is my responsibility to make myself aware of any travel advisories or travel restrictions in regards to the destinations that I am traveling to.
Risks of Travel
I accept that DATM Travel is not responsible for, nor will I attempt to hold either DATM Travel or my DATM Travel Independent agent liable for any injury, illness, damage or loss I may suffer on the account of any conditions, weather, actions or omissions that are beyond reasonable control. I agree that this disclaimer includes the entire traveling party and that in the event of any disputes; they may only be litigated in the state of Oklahoma, Rogers County, with a maximum penalty not to exceed the total earned by DATM Travel in the original transaction.
COVID-19 Release, Assumption of Risk, Waiver of Liability & Indemnity Agreement
The 2019 Novel Coronavirus* (COVID-19, “Coronavirus”) is a known and rapidly evolving pandemic that is affecting travel worldwide, with continued spread and impacts expected. I am fully aware of the current global Coronavirus COVID-19 virus outbreak, the current travel restrictions, and inherent risks involved if choosing to travel. I understand that it is my responsibility to check the latest travel information regarding this virus outbreak with the CDC. https://wwwnc.cdc.gov/travel/notices I understand that it is my responsibility to have travel insurance to ensure I have coverage for all medical needs and trip cancellation, but also understand that concerns or fear of travel is not a covered reason for cancellation relating to the Coronavirus/ Covid-19 and will be denied. I hold DATM TRAVEL harmless for my election to not purchase travel insurance or any denial of claim by travel insurer as it relates to Covid-19 or any other claim under the policy. Travel insurance generally only covers unforeseen events. Most insurers classified COVID-19 as a 'known event' late January 2020. Please note that most policies have a specific clause stating they do not cover epidemics and pandemics, especially when travel warnings are in place. I understand that I am bound by the terms of the insurance policy as it relates to Coronavirus/Covid-19. I am aware of the travel warnings, travel restrictions and rules and understand the risks. I am accepting of these and will hold DATM TRAVEL harmless for any travel restrictions, death, illness, cancellations by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider, financial loss, quarantining rules or measures put in place at airports or destinations I am traveling through. I further agree to hold Dreaming About The Mouse Travel, LLC harmless for any financial penalties or fees imposed by the by suppliers, hotels, airlines, cruise lines, tour agencies or any other travel provider due to cancellations or postponements due to Covid 19 and agree not to institute a credit card dispute or “charge back” to Dreaming About The Mouse Travel, LLC for said penalties or fees.
Payments
I understand that I have authorized this transaction and will hold DATM Travel agency harmless with respect to these instructions. It is understood that the above agency may request government issued photo identification and may verify the billing address of the card. I understand that all payments are made directly to the vendor on my behalf and that DATM is not taking any money directly unless I am paying a planning fee. All planning fees are non-refundable. I have been advised to use a form of payment other than cash or check that may offer me the opportunity to dispute the charge should a vendor cease operating. I have also been advised that all payments made on my behalf will be made directly with the vendor. I understand that the airline tickets, air tours or other products I am purchasing are subject to supplemental price increases that may be imposed after the date of purchase. Post-purchase price increases may be applied due to additional costs imposed by a supplier or government. I acknowledge that I may be charged additional sums by DATM Travel to offset increased fees, fuel surcharges, taxes, and fluctuations in foreign exchange markets or any combination thereof. I hereby consent to any post-purchase price increases and authorize DATM Travel to charge payment for such additional amounts after I have been notified of pricing change.
Cancellations
All cancellation requests must be sent to us in writing. As a result of cancellation or changes to confirmed bookings, third-party Supplier’s cancellation penalties will apply. Cancellation fees will be charged to the credit card or other payment method you authorized to pay for travel services or deducted from the Supplier’s refund, if any. I understand that if there is a cancellation where a refund is due to me by a supplier that any refunds will be put back on the original form of payment by the supplier. I understand that if I pay for my trip with a gift card and a refund is due back to me that the refund will be put back on the original gift card. It is my responsibility to keep my gift cards. I understand that if I cancel there may be a cancellation fee imposed by the supplier. I understand that if I cancel my DATM travel advisors reserves the right to invoice me a $150 cancellation fee per reservation to help cover the cost of the advisors time for working on my booking. No reservations will be cancelled with the supplier until cancellation fee is received by the agency. This will be invoiced through PayPal.
Travel Insurance
I understand travel insurance has been offered to me for purchase to cover certain risks inherent in travel such as trip interruption and/or the inability to travel due to a medical or personal emergency. If I choose not to purchase travel insurance or if I purchase travel insurance on my own (not through DATM Travel), I understand that DATM Travel requires that I confirm or decline insurance in writing.
FORCE MAJEUR
Dreaming About the Mouse Travel, LLC will not be in breach of these terms and conditions or otherwise be liable to you, for any failure or delay in performing an obligation under this Agreement that is due to any of the following causes, to the extent beyond its reasonable control: acts of God, accident, riots, war, terrorist act, epidemic, pandemic, quarantine, civil commotion, breakdown of communication facilities, including web host and internet service provider, breakdown or malfunction of equipment, destruction of or serious damage to facilities, natural catastrophes including, but not limited to extreme weather events, floods and volcanic eruptions, governmental acts or omissions, changes in laws or regulations, national strikes, fire, explosion, generalized lack of availability of raw materials or energy, and any other unforeseen circumstance which is beyond the control of Dreaming About the Mouse Travel, LLC. In addition, our Suppliers may have terms and conditions which include Force Majeure provisions. In the event that a Force Majeure event occurs, those Suppliers may be entitled to, and may in their sole and absolute discretion, vary, postpone or cancel any itinerary or arrangement in relation to the trip. Payment of any refund to you as a result of the non-performance of any obligations hereunder shall remain in the sole and absolute discretion of the Supplier, pursuant to their policies, although Dreaming About the Mouse Travel, LLC shall use its reasonable efforts to secure reimbursement for you where possible.
Limitations of Liability
Because Dreaming About the Mouse Travel, LLC acts as agent for suppliers and does not have the right to control the operations of such independent operators and suppliers, you agree that we are not liable for any personal injury or property damage, which may arise out of these services. Any recovery by you from agency will be limited to the amount of commissions or fees actually received by agency for providing booking services to you directly related to such recovery on a case-by-case basis. Agency’s sole obligations and liabilities are as stated in these terms. All other representations or warranties—express or implied, by statute, law, or otherwise—are excluded. hereby disclaims any liability whether based on contract, tort, strict liability or otherwise, including without limitation liability for any direct, punitive, special consequential, incidental or indirect damages, in connection with the goods or services provided by any supplier booking through us, including without limitation liability for any act, error, omission, injury, loss, accident, delay or irregularity which may be incurred through the fault, negligence, willfull acts, omissions or otherwise of such supplier, or of any supplier or their respective employees, agents, servants, or representatives, including, without limitation, their failure to deliver or their partial or inadequate delivery of services, their cancellation and refund policies, fuel increases, bankruptcy or cessation of operations and other matters outside of our control, and you exonerate us from any liability with respect to the same. Any recovery by you from agency will be limited to the amount of commissions or fees actually received by agency for providing booking services to you directly related to such recovery on a case-by-case basis. Agency’s sole obligations and liabilities are as stated in these terms. All other representations or warranties—express or implied, by statute, law, or otherwise—are excluded.
General
The laws of the State of Oklahoma govern these Terms and Conditions. You hereby consent to the exclusive jurisdiction and venue of courts in Rogers County, Oklahoma in all disputes arising out of or relating to travel bookings with Dreaming About The Mouse Travel, LLC. If any part of these Terms and Conditions is determined to be invalid or unenforceable pursuant to applicable law including, but not limited to, the warranty disclaimers and liability limitations set forth above, then the invalid or unenforceable provision will be deemed superseded by a valid, enforceable provision that most closely matches the intent of the original provision and agreement shall continue in effect. These Terms and Conditions (and any other terms and conditions referenced herein) constitute the entire agreement between the Client and Agency with respect to travel bookings made with Dreaming About the Mouse Travel, LLC by any means, and it supersedes all prior or contemporaneous communications and proposals, whether electronic, oral, or written, between Client and Dreaming About the Mouse Travel, LLC with respect to communications with Dreaming About the Mouse Travel, LLC. A printed version of this agreement and of any notice given in electronic form shall be admissible in judicial or administrative proceedings based upon or relating to these Terms and Conditions to the same extent and subject to the same conditions as other business documents and records originally generated and maintained in printed form.
